Through the Austrian Hotel Contracting Regulations, Wagrain is able to give you very clear guidelines in the eventuality that illness or an unforeseen event prevents you from travelling on your Austrian vacation.
§ 5 Rescission of the Lodging Contract – Cancellation Penalty  Â
Rescission by the Lodging Provider
5.1 If the lodging contract provides for a deposit and the deposit has not been made in a timely fashion, the lodging provider can rescind the lodging contract without a grace period.
5.2 If the guest fails to appear by 6:00 pm of the stipulated arrival day, the lodging provider is no longer obliged to provide lodgings, unless a later arrival time had been previously agreed upon.
5.3 If, however, the contractual partner has made a deposit (see 3.3), then the rooms will be kept vacant until 12:00 pm of the day following the stipulated arrival day. In the event of advance payment of more than four days, the obligation to provide lodging ends at 6:00 pm of the fourth day, in which instance the arrival day is calculated as the first day, unless the guest has notified the lodging provider of a later arrival day.
5.4 Until no later than 3 months prior to the stipulated arrival day of the contractual partner, the lodging contract can be dissolved by means of unilateral declaration on the part of the lodging provider due to reasons dictated by circumstances, unless other arrangements had been previously stipulated.
Rescission by the Contractual Partner – Cancellation Penalty
5.5 Up to no later than 3 months prior to the stipulated arrival day of the guest, the lodging contract can be unilaterally rescinded by the contractual partner without payment of a cancellation penalty.
5.6 Subsequent to the time frame described in § 5.5, unilateral rescission by the contractual partner is only possible through payment of the following cancellation penalties:
- Up to 1 month prior to the arrival day: 40% of the total package price;
- Up to 1 week prior to the arrival day: 70% of the total package price;
- In the last week prior to arrival day: Â 90 % of the total package price.
§ 6 Provision of Alternate Lodgings  Â
6.1 The lodging provider may provide to the contractual partner and/or guests adequate alternative lodging (of equal quality), if this may reasonably be expected of the contractual partner, especially if the discrepancy is minimal and justified by circumstances.
6.2 Such a justification would exist, for example, if the room (rooms) had become unusable, guests already staying there had extended their stays, the establishment is overbooked or if other business-related matters make this step necessary.
6.3 Any and all additional expenses related to provision of the alternate lodgings shall be borne by the lodging provider.
